<p>3.3% of all enquiries in July were directed at Bulgarian property, marking the country&#8217;s return to the overseas property portal&#8217;s top ten for the first time in three years,</p>
<p>The most popular countries remain the same, with Spain staying in the top spot for a second month running. Together with France, USA and Portugal, the traditional destinations account for over a third of all property searches from buyers interested in property abroad.</p>
<p>Director Dan Johnson said: &#8220;As the Euro debt crisis continues, people are looking for bargain investments and holiday homes at low costs. Bulgaria&#8217;s real estate sales have been improving all year, with buyers attracted by exceptionally low prices for winter property, so it&#8217;s no surprise that interest has increased.&#8221;</p>
<p>Bulgaria&#8217;s boost may not rival the traditional Western European destinations, but its growing popularity indicates an interesting shift away from familiar markets as searches for property in Greece and Thailand both declined.</p>
<p>The biggest movers of the month are the prime estates of the Caribbean with the Cayman Islands climbing 17 places, while Barbados entered the top ten with a jump of four places.</p>

Current Tenants : If there is a tenant staying in the property you like to buy, you are advised to check the tenancy contract. In some cases, you’d better see the tenant. Furthermore, please check whether the tenant has given the seller an evacuation notice or not. If he has given a notice, then you ought to check whether the dates stated in the Sale Contract and the Evacuation Notice fit properly.</p>
<p>Double Checking the Registry Records : When you are offered a property, please compare the information relating to the property which sellers declared to you to the local title deeds registry office records. In other words, please double check the title-deeds belonging to the seller to see</p>
<p>Whether the actual address of the property and the address shown on the Title-Deeds are the same,<br />
Whether there is more than one owner (if so, make sure that all shareholders comply with the sale),<br />
Whether there are special clauses on the title-deeds which prevent the transfer of ownership owing to a long-term debt owed to a bank.</p>
<p>Appropriateness of the building: According to current legislation, all buildings have to obey the construction and earthquake-proof regulations and official plans. In this regard, you should double check whether the building has been built in line with those arrangements. In other words, you should ask the seller to provide you with the `Use of Building` Permit ( “Yapi Kullanim Izni” in Turkish.) issued by the local authorities.</p>
<p>Buildings under construction: If you are to buy a building under construction, make sure that the contractor is financially viable and legally authorised. Furthermore, you are recommended to put some special clauses in the contract with the contractor such as a date of completion, list of materials to be used, indemnities etc.</p>
<p>Construction of a building on a land: All issues relating to construction of buildings/building rights are arranged by Construction Law No. 3194. According to the law, you can have a building constructed on your own land provided that, It is in line with the official Construction Plans and current regulations.<br />
You obtain a “construction authorisation” certificate from the local governments.</p>
<p>With regards to the authorisation for building rights, if your land is within municipal borders, the relevant municipality authorises the construction. If your land is outside the municipal borders, then the relevant provincial governor’s office (“Valilik” in Turkish) authorises you.</p>
<p>Please bear in mind that you cannot construct any building on lands which are allocated as common places such as roads, green fields, and parks in the official Construction Plans. If you plan to buy a land and to build a property on it, you are advised to search for the relevant official Construction Plans approved by the local governments and regulations, and to contact the relevant local governments. Hiring a good solicitor would be beneficial at his step.</p>
<p>Residency Permits for Newly Constructed Buildings: A residency permit (“Oturma Izni” or “Yapi Kullanma Izni” in Turkish) is a document that shows the construction of the building has been completed in line with the authorisation given by the Municipality (Belediye). This document also includes the information regarding construction authorisation, completion date of the construction works, the land registry office records on the property, address &amp; size of the property, specifications of the independent parts in the property, and the owners. Residency permit is provided by the Construction Licenses Directorate (Yapi Izinleri Müdürlügü) and Construction Supervision License Directorate (Yapi Denetim Izni Birimi) within a Municipality.</p>
<p>Without this document you can neither live in the property in question nor subscribe to the utility companies.</p>
<p>Required Documents</p>
<p>• Petition<br />
• Copy of the title deeds<br />
• A document to be gathered from local tax offices to evidence that the owner does not owe anything to the tax office.<br />
• External Sewage Document (Water Utility Directorate of the Municipality provides with it)<br />
• Turk Telekom’s suitability approval for future telecom connections<br />
• Scientific Responsibility Report (”Fenni Mesul Raporu” in Turkish)<br />
• Frontal photographs of size 13×18 cm<br />
• If there is an elevator/lift in the property, guarantee &amp; technical standards documents, engineers’ documents, supervision report, supervision receipts, application projects approved by the relevant chamber are also needed.<br />
• Air-raid shelter report for the building where a shelter is designated<br />
• Fire brigade reports for the buildings where fire exits are compulsory</p>
<p>Who can apply for it?</p>
<p>You or your agent (Power of Attorney holder) can apply to the aforementioned department in the municipality. As well as the documents listed above, please make sure the visas regarding the application, the base (zemin), the parts above the base (”su basman” in Turkish), heat insulation and general construction (kaba insaat).</p>
<p>What is the cost of residency permit?</p>
<p>An examination fee and the corresponding levy, which are very low compared to the European examples, are charged on the basis of the area (number of meter squares) of the property. The unit prices for these fees are updated periodically. Please contact the municipality in question for the updated figures.</p>
<p>Housing Co-operatives</p>
<p>Housing Cooperatives are legal entities established in line with Law No. 1163 and aim at providing their partners (or participants) with residential flats or houses. These entities are one of the most favorable methods of acquiring a property among Turkish citizens, who are generally at the middle income levels. Tax advantages and relatively cheaper loans provided by State organizations, great potential for economies of scale, and convenient financing requirements evenly distributed to a time scale extending to a couple of years are some of the appealing features of these entities.</p>
<p>However, right management of a cooperative is of high importance. The Board should assure a sound financial status and employing the right contracting company which will construct the complex is very crucial. Unless a good Board which is composed of trustworthy and talented people is in office, the designated targets may not be attained.</p>
<p>In this regard, if you are planning to purchase a flat, house or villa on a complex, as a part of a cooperative, you are strictly advised to search for all important and relevant aspects. You can hire a professional to do this on behalf of you. In case you need professional help, please be sure that you assign the professional in question through a sound Power of Attorney.</p>
<p>The following information briefly explains how cooperative mechanism works.</p>
<p>A cooperative has to have at least 7 partners (or participants or members). The Articles of Association (AA) has to be stamped by a notary public and to be registered to the Trade Registry. The followings are to be clearly stated in an AA:</p>
<p>• The name and address of the cooperative,<br />
• Purpose and activities of the cooperative,<br />
• The conditions which cause participants to lose their partnership,<br />
• Shares of participants,<br />
• The degree of the rights and liabilities of participants,<br />
• How the cooperative can be represented,<br />
• Methods for how revenues and expenditures accrue,<br />
• Names and addresses of the founders,<br />
• How contributions will be made by the participants,<br />
• Other issues, where applicable.</p>
<p>Cooperatives have to arrange ‘partnership notes’ in the name of each partners and these documents have to be signed by participants and the representatives of the cooperatives. These notes are delivered to the partners and indicate that the note holder has a legal partnership in the cooperative.</p>
<p>Main decisions regarding a cooperative’s activities are made by the General Assembly, composed of partners. Usual General Assembly meeting has to be held within a period up to 3 years following the previous meeting. Participants are officially invited to General Assembly meetings by the people authorised to represent the cooperative. These representatives are selected by the General Assembly.</p>
<p>Bringing the partnership to an end is allowed by the Law. In some cases, there might be some special time restriction clauses in the AA. AA may envisage that partnership cannot be brought to an end within a period up to 5 years following the date of partnership. If any force majeure conditions are specified in the AA and a participant falls in a force majeure, then he is exempt from such time restriction. Partnership rights can be transferred to others or sold out. According to the regulations, any partner is allowed to ask the Board of a Cooperative to provide him/her with the information about the financial status of the cooperative.</p>
<p>A cooperative dissolves if</p>
<p>• All works envisaged by the AA have been materialized and the properties have been registered in the names of the participants.<br />
• The General Assembly decides upon that the cooperative will no longer continue.<br />
• Bankruptcy is declared.<br />
• Relevant Courts have made a decision to dissolve the cooperative.<br />
• Another cooperative takes over or purchases it.<br />
• Usual General Assembly meeting has not been held for at least 3 years.<br />
• The relevant ministry finds out that the cooperative can no longer attain the designated targets.</p>

Back in modern contemporary Didim owners tried to get some money from the sterile area of snuff in the neighborhood, but left early. About 15 years ago, people in the big cities of Turkey such as Istanbul, Ankara, Izmir and the first time in Altinkum and started to build their own summer homes or vacation homes.</p>
<p>Currently, they have built villas and apartments for sale in Altinkum and other smaller cities as part of the properties of emerging companies in the area. This is a brief history of a city that has transformed the very fertile land into a thriving real estate business, to welcome more foreign tourists, attracted by the sunny climate and fascinated by the exotic lifestyle in Turkey. Currently, Didim property values have increased dramatically as foreign buyers to follow the example of football started by local entrepreneurs and are increasingly interested in buying a house or apartment for sale in Altinkum.</p>
<p>Didim is growing rapidly into a holiday resort completely different than it used to be 10-15 years ago welcoming large population of tourists with its beautiful beaches, ancient churches and temples, and traditional culture.</p>
<p>Didim has its own microclimate and benefits for hundreds of days of sunshine a year and warm winters, allowing tourists and foreign residents as a result of Didim property to enjoy the famous beach even in January. Geographically speaking, Didim is much closer to the ancient towns and natural wonders that most resorts in Turkey and that is another key, which advises the district in the eyes of tourists. There are many things that tourists and foreign residents can do in Altinkum and swim until sunset.</p>
<p>But the main attraction in Altinkum, as elsewhere in Turkey, is the traditional Turkish bath. The Turkish bath is something you have to experience the lovely hot sauna where you feel dizzy from the heat, hot table, where before reaching a clutch and a soap massage. After a visit to the Turkish baths, you can just feel relaxed and energized at the same time.</p>
<p>Altinkum means “golden sand” and both as a tourist or an investor interested in a property in Didim or apartment for sale in Altinkum, you can quickly see how the city got its name. Altinkum beaches, affected by the gentle waves of the inviting turquoise Aegean Sea. You can also discover the natural coves and bays by boat trips arranged.</p>
<p>The boats leave from the port every day in the summer season, which begins in early May. Water sports, diving courses, fishing excursions are also available. The adventurous can explore the region through travel agents who organize tours to Lake BAFA, Akkoy fraction (or the “White People” as the local houses are white stone), Didyma – Miletus – Priene – Ruins, Ephesus – House of the Virgin Mary, Pamukkale, known by the Turkish people as the 8th wonder of the world, and many ancient place, each with an extraordinary story.</p>
<p>Altinkum is a local resource and easily find casual and relaxed in their attitude towards tourists. By the time you have to know, there’s nothing better than enjoying chatting over a glass of apple tea in Turkey, famous in all restaurants and bars are here, offering an international menu and organizing special evening Turkish Turkish food. <p>The law governing leases in Turkey is a blend of the well established legal principle of freedom to contract and the more modern government predilection for protecting the weaker of two parties. Freedom to contract was recognized in the Turkish Civil Code in 2002 and somewhat expanded in 2007. Providing greater protection to those in a weaker bargaining position has been around as long as there have been politicians. (Since there are more renters who are voters than there are landlords, it is not difficult to understand the basis for this concept.)</p>
<p>The original Law on the Lease of Real Property No. 6570 was enacted on May 18, 1955 and has not been substantially modified since. One interesting aspect of this law is that it has different rules for properties located within and outside municipalities. For example, with respect to real property located within municipal borders, the termination of a lease is different. Within a municipality, if a tenant does not notify their landlord in writing that he/she wishes to terminate the lease agreement 15 days prior to the expiration date of the lease, the agreement is automatically renewed for one more year with the same conditions. However, this is not the case for rental property outside municipal boundaries.</p>
<p>There are no legal restrictions limiting the maximum term of a private real property lease (including renewals), but according to the Public Procurement Law No. 2886, leases of state owned real property (other than tourism facilities) may only be tendered for a maximum period of 10 years. Land rented for tourism projects may be leased for terms up to 49 years. This makes one wonder as to the fate of some of the magnificent seaside resorts that are located on land leased from the government such as The Cirağan Kempinski Hotel in Istanbul and the Rixos Hotel in Antalya, as well as urban development projects like the Akaretler Sıraevleri Row Houses when their leases expire. Under Turkish Law, private landlords may only terminate a lease agreement and evict the tenant pursuant to a legitimate cause specified by law.</p>
<p>The predominant permissible reasons for eviction include the landlord or its family requiring the premises as a residence or a workplace, the need for major renovation and rehabilitation of the building, failure of the tenant to pay rent (subject to the requirement of the landlord serving the tenant with two written demands to pay the rent within a one year period), and breach of the terms of the lease. Lease termination by tenants is another matter entirely. As is the case in most of the world, if a tenant terminates the lease prematurely, he/she must continue to pay the rent until the property is re-leased to a new tenant or for a reasonable period during which under normal circumstances a landlord could reasonably be expected to be able to re-lease it.</p>
<p>This reasonable period may be determined by a court decision. This grants the court a significant amount of leeway, which indubitably weighs in favor of the tenant, especially if there were extenuating circumstances brought to bear by the landlord such as not making timely repairs, or allowing other tenants to disturb the terminating tenant. In addition, the law provides that tenants are allowed to terminate a lease agreement by paying reasonable compensation to the landlord and by claiming that the continuation of the lease is unsustainable. If the lease term is for more than one year, the compensation cannot be less than 6 month’s rent. Unless otherwise stated in the agreement, early termination of the lease agreement by the tenant is not legally permitted unless there are exceptional circumstances such as massive currency devaluation, forced moving to another city, or cancellation/closing of the business that employs the tenant. There is no restriction on transfer of ownership of a real property that is subject to a lease.</p>
<p>According to the Law, if leased real property is transferred to a third party, the new landlord may terminate the lease agreement with a 6 months prior notice to be served to the tenant. This prior notice must be delivered to the tenant within one month of the date of transfer. In order for this termination to be valid, the new owner must demonstrate that he/she needs the premises as a residence either for him or herself or for his family and/or for a place of business. If the new landlord fails to serve the notice within a month after the transfer of the property and/or in the absence of causes for eviction specified in Law he/she will be bound by the terms of the lease agreement.</p>
<p>Although there is no formal requirement for having a written lease agreement and verbal lease agreements are valid, for the lease to be enforceable against third parties, an annotation should be recorded at the land registry directorate where the leased property is registered. The importance of this provision in the law cannot be overstated in cases where the value of the lease is substantial to the tenant. This can be for reasons such as location, tenant improvements such as store or restaurant fit out and fixtures, or a trend of significant increases in rents in the neighborhood.</p>
<p>Other than the provision mentioned above allowing landlords to terminate a lease because of their personal needs, there is nothing unusual about Turkish lease law compared with US or Western European practice. There are many other legal provisions that space doesn’t permit to be included in this article, so before entering into a lease, the prospective landlord and tenant should both consult with attorneys experienced with Turkish real estate law.</p>
